By accessing or purchasing from this website, you agree to comply with and be bound by the following Terms & Conditions (“Terms”, “Terms of Service”).

These Terms apply to all users of the site, including without limitation browsers, customers, and contributors of content.

1. OVERVIEW

FanMerch.co.in is a custom printing and apparel platform. All our products are made to order, printed or manufactured specifically as per the customer’s selection, design, and input.
By using our website, you agree that you have read, understood, and accepted these Terms & Conditions, along with our Privacy Policy and Return & Refund Policy.

FanMerch reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the website constitutes acceptance of any such changes.

2. ONLINE STORE TERMS

By using this website, you represent that you are at least the age of majority in your state or province of residence.

You may not use our products for any illegal or unauthorized purpose.
You must not transmit any malware, viruses, or destructive code through our site.

FanMerch reserves the right to refuse service or cancel orders at its discretion.

3. CUSTOM PRINTING POLICY

All products sold by FanMerch are custom-made, meaning they are printed or produced according to the customer’s input, design, or specifications.

Customer Responsibility:

  • You confirm that you have all necessary rights and permissions to use any artwork, logo, text, or design uploaded or shared with us.

  • By submitting any design for printing, you declare that the content does not infringe on any third-party copyright, trademark, or intellectual property.

  • FanMerch (Zestful Retail) is not responsible for any copyright or trademark infringement caused by customer-provided content.

  • If any dispute arises due to your uploaded design, you agree to indemnify and hold FanMerch harmless against all claims, damages, or expenses arising therefrom.

Design Disclaimer:

FanMerch reserves the right to reject any design that:

  • contains offensive, obscene, or illegal material,

  • violates any law or regulation, or

  • infringes on any third-party intellectual property.

4. MADE-TO-ORDER & PRODUCTION POLICY

  • All orders are made to order and non-returnable.

  • Orders can be cancelled within 8 hours of placement for a full refund.

  • After 8 hours, production begins and cancellation refunds are limited as per our Return & Refund Policy:

    • 50% refund for general products after 8 hours.

    • 25% refund for custom printed T-shirts after 8 hours, as they are personalized and cannot be reused.

5. PRICING, BILLING & TAXES

All prices listed on FanMerch.co.in are in Indian Rupees (INR) and inclusive of applicable GST.

We reserve the right to update prices, discounts, or offers at any time without notice.

Invoices will be generated under Zestful Retail, and customers will receive tax-compliant GST bills for all valid transactions.

6. SHIPPING & DELIVERY

FanMerch aims to dispatch all orders within the estimated processing time mentioned on each product page. However, delivery times may vary due to printing, customization, and courier availability.
We are not liable for delays caused by courier or logistics providers.

7. ACCURACY OF INFORMATION

While we strive to maintain accurate product information, minor variations in print, color, or size may occur due to screen settings or printing processes. Such variations are not considered defects.

8. INTELLECTUAL PROPERTY

All FanMerch logos, brand names, designs, and product mockups are the property of Zestful Retail.
Unauthorized reproduction or use of our intellectual property is strictly prohibited.

Customer-uploaded designs remain their property, and FanMerch makes no claim over them.

9. LIMITATION OF LIABILITY

FanMerch shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

  • Use of customer-provided designs,

  • Delays in printing or shipping,

  • Typographical errors, color mismatches, or minor variations, or

  • Misuse of the website or services.

All services and products are provided “as is” and without any warranty, express or implied.

10. PROHIBITED USES

You are prohibited from using the website or its content for:

  • Uploading infringing or illegal designs,

  • Harassing or abusing others,

  • Attempting to hack, spam, or misuse site data,

  • Reselling products without permission.

FanMerch reserves the right to terminate accounts violating these terms.

11. GOVERNING LAW & JURISDICTION

These Terms of Service and any disputes arising out of or in connection with your use of FanMerch.co.in shall be governed by and construed in accordance with the laws of India.
All legal disputes are subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.

12. FORCE MAJEURE

FanMerch shall not be held responsible for any delay or failure in fulfilling obligations caused by events beyond our reasonable control — including but not limited to strikes, natural disasters, internet outages, or government restrictions.
